1. Acceptance of Terms
By accessing or using VIVID, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.
2. Description of Service
VIVID provides AI-powered content creation tools including image generation, video generation, and product analysis. Services are provided on a subscription basis with credit-based usage limits.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information and keep it up to date. You are responsible for all activity under your account.
4. Content Ownership
You retain ownership of all content you upload. Content generated by VIVID using your inputs is owned by you with full commercial usage rights. You must have the necessary rights to any images you upload.
5. Prohibited Use
You may not use VIVID to create content that is illegal, harmful, or violates the rights of others. You may not use the service to generate deepfakes or misleading content without proper disclosure.
6. Payment and Refunds
Paid subscriptions are billed monthly through Stripe. You may cancel at any time. We offer a 30-day money-back guarantee on first subscriptions. Credits are non-transferable.
7. Limitation of Liability
VIVID is provided 'as is' without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.
8. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
9. Artificial Intelligence and EU AI Act
VIVID uses generative artificial intelligence systems (including Flux, Kling, Sora, Veo, Seedance, and other models) to produce synthetic content such as images, videos, and analysis. All content generated through VIVID is produced by AI and should be treated as such. In accordance with EU Regulation 2024/1689 (AI Act), the user undertakes to: (a) not remove or alter AI-generated labels or metadata from produced content; (b) disclose the use of AI when publishing generated content on third-party platforms; (c) not use generated content to deceive or mislead third parties about the nature of the content. VIVID reserves the right to embed provenance metadata in generated content to ensure regulatory compliance.
