1. Acceptance of Terms
By accessing or using VIVID, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.
2. Eligibility
VIVID is a business tool for professional use. You must be at least 18 years old, or the age of majority in your country, to create an account and use the Service. The Service is not directed to children: we do not knowingly collect personal data from anyone under 18, and we will close any account we find to belong to a minor and delete the associated data.
3. Description of Service
VIVID provides AI-powered content creation tools including image generation, video generation, and product analysis. Services are provided on a subscription basis with credit-based usage limits.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information and keep it up to date. You are responsible for all activity under your account.
5. Content Ownership
You retain ownership of all content you upload. Content generated by VIVID using your inputs is owned by you with a full, unlimited commercial licence: you may reproduce, modify, distribute and resell it, including after your subscription ends. You must hold all necessary rights to the materials you upload. You are solely responsible for the prompts and inputs you provide, and you agree not to generate content that infringes the trademarks, copyrights, image rights or other rights of third parties (for example protected characters, logos or brands). VIVID exercises no prior editorial control over prompts and disclaims all liability for content generated on your instruction that infringes third-party rights; you agree to indemnify and hold VIVID harmless from any claim, damage or cost arising from such infringement.
6. Prohibited Use
You may not use VIVID to create content that is illegal, harmful or violates the rights of others, nor to generate deepfakes or misleading content without proper disclosure. It is strictly forbidden to create, upload or request sexual or intimate images or videos of any person, real or realistic, with or without their consent (so-called AI NCII, AI-generated non-consensual intimate imagery), nudity, sexual content involving minors, and content depicting a real person without their consent. VIVID is a tool for the commercial communication of products: automated filters refuse such requests, and a violation leads to the immediate suspension of the account without refund and to a report to the authorities where the law requires it.
7. Payment and Refunds
Paid subscriptions are billed monthly through Stripe. You may cancel at any time. We offer a 30-day money-back guarantee on first subscriptions. Credits are non-transferable.
8. Right of Withdrawal
If you are a consumer (a natural person acting for purposes outside your trade, business, craft or profession), you have the right to withdraw from the contract within 14 days of its conclusion (the date of first payment), without giving any reason and without penalty, pursuant to Directive (EU) 2011/83 (Consumer Rights Directive) and, in Italy, Articles 52-59 of the Consumer Code (Legislative Decree 206/2005). To exercise this right, simply send us, before the 14-day period expires, an unequivocal statement of your decision to withdraw at hello@vividai.tv (you may use the model withdrawal form but are not required to). We will reimburse all payments received from you within 14 days of receiving your withdrawal notice, using the same means of payment you used. IMPORTANT — digital services: VIVID is a digital service supplied with immediate effect. By activating your subscription and accessing the services, you expressly request and consent to the immediate performance of the service before the withdrawal period ends, and you acknowledge that — once the service has been fully performed — the right of withdrawal is lost. If you withdraw while the service is still being provided, you will be required to pay an amount proportionate to the services and credits already used up to the moment of your withdrawal notice. In any event, in addition to the statutory right of withdrawal, VIVID applies the 'money-back guarantee' set out in the 'Payment and Refunds' section, under the conditions stated therein.
9. Limitation of Liability
VIVID is provided 'as is' without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.
10. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
11. Artificial Intelligence and EU AI Act
VIVID uses generative artificial intelligence systems (including Flux, Kling, Sora, Veo, Seedance, and other models) to produce synthetic content such as images, videos, and analysis. All content generated through VIVID is produced by AI and should be treated as such. In accordance with EU Regulation 2024/1689 (AI Act), the user undertakes to: (a) not remove or alter AI-generated labels or metadata from produced content; (b) disclose the use of AI when publishing generated content on third-party platforms; (c) not use generated content to deceive or mislead third parties about the nature of the content. VIVID reserves the right to embed provenance metadata in generated content to ensure regulatory compliance.
12. API, MCP server and connected apps
You can use VIVID through the web app, the REST API, the open-source vivid-mcp server and third-party AI assistants (for example Claude by Anthropic or ChatGPT by OpenAI) connected through OAuth. All of these are part of the Service and are governed by these Terms. Requests made through the API or a connected app are actions under your account: they consume credits exactly like the web app and you are responsible for them. Your API key is a personal credential: keep it secret, do not share it and rotate it from Settings if you suspect it has been exposed. Each connected app receives its own access credential, which you can revoke at any time from Settings → Connected apps; revocation takes effect immediately and does not affect the rest of your account. Third-party assistants are provided by their operators under their own terms and policies: VIVID does not control how they interpret your instructions or what they do with the content they receive, and is not responsible for their availability or behaviour. Automated use must stay within the rate limits of the Service; we may throttle or suspend access that degrades the Service for other users or circumvents these Terms.
